Flag Controversy Surrounding Supreme Court Justice Alito
Recent events have brought attention to the flags flown at the vacation homes of Supreme Court Justice Samuel Alito, sparking controversy and discussions.
Flag Symbolism
One flag, associated with the “Stop the Steal” campaign, was raised over Alito’s New Jersey vacation home in July and September of 2023. This flag carries religious connotations within the campaign.
Another flag, bearing the message ‘Appeal to Heaven,’ was flown by individuals involved in the Capitol attack on January 6, 2021. Interestingly, this same flag was observed flying over Justice Alito’s residence last summer.
Alito’s Response
Alito explained that his wife raised the inverted American flag at their Virginia home in response to a neighborly dispute, emphasizing his lack of involvement in the matter.
However, Alito chose not to address questions regarding the flag displayed at their beach house.
Public Reactions
Senate Majority Whip Dick Durbin has urged Alito to recuse himself from cases related to the 2020 election and the January 6 insurrection, citing concerns about impartiality.
Furthermore, discussions on ethics within the Supreme Court have intensified, with calls for Chief Justice John Roberts to enhance the court’s ethics code with an enforcement mechanism.

House Speaker Mike Johnson has also showcased a similar flag outside his office, drawing criticism from groups like the Freedom from Religion Foundation, who view it as a symbol endorsing Christianity.
