ICC prosecutor Karim Khan filed arrest warrant applications, citing “reasonable grounds to believe” that the mentioned leaders are responsible for war crimes and crimes against humanity committed in Gaza. Clooney’s role as a special adviser in this case was crucial in evaluating the evidence.

ICC’s chief prosecutor Khan commended Clooney and the panel of experts for their invaluable contributions to the evaluation of evidence related to war crimes. He highlighted the panel’s expertise in international humanitarian and criminal law.

The panel, after extensive review and legal analysis, determined that Hamas leaders Yahya Sinwar, Mohammad Deif, and Ismail Haniyeh, as well as Netanyahu and Gallant, have committed various war crimes. These include acts such as hostage-taking, murder, crimes of sexual violence, starvation as a method of warfare, persecution, and extermination.

Opposition and Controversy

The ICC’s legal actions faced opposition from the United States and Israel, who contested the court’s jurisdiction. US President Joe Biden defended Israel, emphasizing the lack of equivalence between Israel and Hamas in the conflict.
